제18조(벌칙):
1. 다음 각 목의 어느 하나에 해당하는 자는 10년 이하의 징역 또는 1억원 이하의 벌금에 처합니다.

• 제1항의 죄를 범하여 지급을 받거나 지급을 청구하거나 이를 약속한 자.
• 미성년자, 의사결정 능력이 없는 사람 또는 중증장애인에게 위계적 또는 권력적 역학관계를 이용하여 성매매를 하도록 강요하는 사람.
• 폭력의 처벌에 관한 법률에 규정된 단체 또는 단체의 구성원으로서 제1항의 죄를 범한 자.
3. 다음 각 호의 어느 하나에 해당하는 자는 3년 이상의 징역에 처해질 것입니다:
• 집단 권력이나 다수의 개인을 이용하여 타인을 감금하거나 강제로 성매매를 시키는 사람.
• 성노동자의 고용이나 관리에 의해 촉진된 위계적 또는 권력적 역학관계를 이용하여 다른 사람에게 낙태 또는 불임 시술을 하도록 강요하는 사람.
• 폭력의 처벌에 관한 법률에 규정된 단체 또는 단체의 구성원으로서 제2항제1호 또는 제2호의 죄를 범한 자.
4. 다음 각 호의 어느 하나에 해당하는 자는 5년 이상의 징역에 처해질 것입니다.
• 보호 또는 감독을 받는 사람에게 업무, 고용 또는 기타 관계로 인해 마약 또는 이와 유사한 수단을 사용하여 성매매를 하도록 강요하는 사람.
• 폭력행위의 처벌에 관한 법률에 규정된 단체 또는 단체의 구성원으로서 제3항제1호의3의 죄를 범한 자.
제19조(벌칙):
1. 다음 각 목의 어느 하나에 해당하는 자는 3년 이하의 징역 또는 3천만원 이하의 벌금에 처합니다:
• 매춘 또는 관련 활동에 종사하는 사람.
• 매춘을 하기 위해 다른 사람들을 모집하는 사람.
2. 다음 각 호의 어느 하나에 해당하는 자는 7년 이하의 징역 또는 7천만원 이하의 벌금에 처합니다:
• 사업의 일환으로 성매매나 관련 활동을 하는 사람.
• 매춘을 하기 위해 다른 사람들을 고용하고 그에 대한 대가를 받는 사람.
• 성매매와 관련된 직업을 소개하고 알선하며 그 대가를 받는 사람.
제20조(벌칙):
1. 다음 각 목의 어느 하나에 해당하는 자는 3년 이하의 징역 또는 3천만원 이하의 벌금에 처합니다:
• 형법 제245조의 규정에 의한 성매매 또는 음란행위와 관련된 직업을 광고하는 자.
• 성매매 또는 성매매 알선과 관련된 사업을 광고하는 사람.
• 성매수 활동을 장려하거나 참여를 유도하기 위해 광고를 하는 사람.
이 같은 광고를 제작·공급하거나 게시한 사람은 2년 이하의 징역 또는 1천만 원 이하의 벌금에 처합니다.
사업 목적으로 광고를 담은 광고나 간행물을 배포하면 누구나 1년 이하의 징역 또는 500만원 이하의 벌금에 처해질 수 있습니다.
성매매알선 등 행위의 처벌에 관한 법률
제18조(벌칙)
① 다음 각 호의 어느 하나에 해당하는 사람은 10년 이하의 징역 또는 1억원 이하의 벌금에 처한다.
1. 폭행이나 협박으로 성을 파는 행위를 하게 한 사람
2. 위계 또는 이에 준하는 방법으로 성을 파는 사람을 곤경에 빠뜨려 성을 파는 행위를 하게 한 사람
3. 친족관계, 고용관계, 그 밖의 관계로 인하여 다른 사람을 보호ㆍ감독하는 것을 이용하여 성을 파는 행위를 하게 한 사람
4. 위계 또는 위력으로 성교행위 등 음란한 내용을 표현하는 영상물 등을 촬영한 사람
② 다음 각 호의 어느 하나에 해당하는 사람은 1년 이상의 유기징역에 처한다.
1. 제1항의 죄(미수범을 포함한다)를 범하고 그 대가의 전부 또는 일부를 받거나 이를 요구ㆍ약속한 사람
2. 위계 또는 위력으로 청소년, 사물을 변별하거나 의사를 결정할 능력이 없거나 미약한 사람 또는 대통령령으로 정하는 중대한 장애가 있는 사람으로 하여금 성을 파는 행위를 하게 한 사람
3. 「폭력행위 등 처벌에 관한 법률」 제4조에 규정된 단체나 집단의 구성원으로서 제1항의 죄를 범한 사람
③ 다음 각 호의 어느 하나에 해당하는 사람은 3년 이상의 유기징역에 처한다.
1. 다른 사람을 감금하거나 단체 또는 다중(多衆)의 위력을 보이는 방법으로 성매매를 강요한 사람
2. 성을 파는 행위를 하였거나 할 사람을 고용ㆍ관리하는 것을 이용하여 위계 또는 위력으로 낙태하게 하거나 불임시술을 받게 한 사람

4. 「폭력행위 등 처벌에 관한 법률」 제4조에 규정된 단체나 집단의 구성원으로서 제2항제1호 또는 제2호의 죄를 범한 사람
④ 다음 각 호의 어느 하나에 해당하는 사람은 5년 이상의 유기징역에 처한다.
1. 업무관계, 고용관계, 그 밖의 관계로 인하여 보호 또는 감독을 받는 사람에게 마약등을 사용하여 성을 파는 행위를 하게 한 사람
2. 「폭력행위 등 처벌에 관한 법률」 제4조에 규정된 단체나 집단의 구성원으로서 제3항제1호부터 제3호까지의 죄를 범한 사람

제20조(벌칙)

② 영업으로 제1항에 따른 광고물을 제작ㆍ공급하거나 광고를 게재한 사람은 2년 이하의 징역 또는 1천만원 이하의 벌금에 처한다.
③ 영업으로 제1항에 따른 광고물이나 광고가 게재된 출판물을 배포한 사람은 1년 이하의 징역 또는 500만원 이하의 벌금에 처한다.

제21조(벌칙) ① 성매매를 한 사람은 1년 이하의 징역이나 300만원 이하의 벌금ㆍ구류 또는 과료(科料)에 처한다.
② 제7조제3항을 위반한 사람은 500만원 이하의 벌금에 처한다.

• A person who has received payment, requested payment, or promised to do so by committing the crime under paragraph (1).
• A person who compels a minor, a person who has no decision-making ability, or a person with a severe disability to engage in prostitution using hierarchical or power dynamics.
• A person who has committed the crime under paragraph (1) as a member of an organization or organization prescribed in the Punishment of Violence Act.
3. Any person who falls under any of the following subparagraphs will be sentenced to at least three years in prison:
• A person who uses collective power or multiple individuals to imprison or force others to engage in prostitution.
• A person who uses hierarchical or power dynamics promoted by the employment or management of sex workers to force others to perform abortions or infertility procedures.
• A person who has committed a crime under paragraph (2) 1 or 2 as a member of an organization or organization prescribed in the Punishment of Violence Act.
4. Any person who falls under any of the following subparagraphs will be sentenced to at least five years in prison.
• A person who compels a person under protection or supervision to engage in prostitution using drugs or similar means due to work, employment, or other relationships.
• A person who has committed the crime under paragraph (3) 1-3 as a member of an organization or organization prescribed in the Punishment of Violent Acts Act.
Article 19 (Penalty):
1. Any person who falls under any of the following items shall be punished by imprisonment with work for not more than three years or a fine of not more than 30 million won:
• a person engaged in prostitution or related activities.
• Someone who recruits others for prostitution.
2. Any person who falls under any of the following subparagraphs shall be punished by imprisonment with work for not more than 7 years or a fine of not more than 70 million won:
• a person engaged in prostitution or related activities as part of a business.
• Someone who hires others for prostitution and gets paid for it.
• A person who introduces, mediates, and receives a reward for a job related to prostitution.
Article 20 (Penalty):
1. Any person who falls under any of the following items shall be punished by imprisonment with work for not more than three years or a fine of not more than 30 million won:
• A person who advertises occupations related to prostitution or obscene acts under Article 245 of the Criminal Act.
• A person who advertises a business related to prostitution or prostitution.
• A person who advertises to encourage or engage in sex-buying activities.
Those who produce, supply, or post such advertisements shall be sentenced to up to two years in prison or fined up to 10 million won.
Anyone who distributes advertisements or publications containing advertisements for business purposes may face up to one year in prison or a fine of up to 5 million won.
Act on the Punishment of Acts of Prostitution Mediation, etc
Article 18 (Penal Provisions) (1) A person who falls under any of the following subparagraphs shall be punished by imprisonment with work for not more than 10 years or a fine of not more than 100 million won.
1. A person who caused the act of selling sex by assault or intimidation
2. A person who puts a person who sells a castle in trouble by hierarchical or equivalent means to sell a castle
3. A person who has caused the act of selling sex by using the protection and supervision of others due to kinship, employment, or other relationships
4. A person who has filmed videos, etc. expressing obscene content, such as sexual intercourse, through hierarchy or power
② Any of the following persons shall be punished by imprisonment with work for at least one year.
1. A person who has committed the crime (including attempted crimes) under paragraph (1) and has received all or part of the price, or has requested or promised to do so
2. A person who has caused a youth, a person who is incapable of discriminating or making a decision by hierarchy or power, or a person with a serious disability prescribed by Presidential Decree to sell sex
3. A person who has committed the crime under paragraph (1) as a member of an organization or group prescribed in Article 4 of the Punishment of Violence, etc. Act
③ Any of the following persons shall be punished by imprisonment with work for at least three years.
1. A person who has imprisoned another person or forced prostitution in a way that shows the power of group or multiple persons
2. A person who has had an abortion by hierarchy or power or has undergone infertility procedures by using the employment and management of a person who has committed or will sell sex

④ Any of the following persons shall be punished by imprisonment with work for at least five years.

Article 21 (Penal Provisions) (1) A person who has engaged in prostitution shall be punished by imprisonment with work for not more than one year or a fine, detention or non-penal fine of not more than KRW 3 million.
