제14조(장애의 조기 발견 등)
이 법은 영유아의 잠재적 장애와 장애를 조기에 발견하고 개입하는 것이 중요하다고 인정합니다. 시의적절한 신원확인을 위해 교육장 또는 교육감은 지역 보건소, 병원 또는 진료소에서 무료 검진을 실시하도록 의무화되어 있습니다. 또한 지방자치단체, 보건소, 병원, 진료소 간의 협력체계를 구축하여 효율적인 심사가 이루어질 수 있도록 지원하고 있습니다. 영유아나 학생의 장애가 의심되는 경우 보호자 또는 학교 당국은 보호자의 동의를 얻어 해당 교육청 또는 교육감에게 진단 및 평가를 의뢰해야 합니다. 교육청 또는 교육감은 요청이 있을 경우 신속하게 특수교육지원센터에 사건을 의뢰하고 진단 및 평가결과를 영유아와 보호자에게 전달합니다. 구체적인 심사 절차, 동의 및 통보 절차는 대통령령으로 더 자세히 설명되어 있습니다.
제15조(특수교육대상자의 선정)
이 법은 특수교육 대상자 선정 기준을 규정하고 있습니다. 교육장 또는 교육감은 특수교육이 필요하다고 진단되고 평가된 개인을 선발할 책임이 있습니다. 이 선정은 대통령령으로 정하는 시각장애, 청각장애, 지적장애, 신체장애, 정서·행동장애, 자폐장애, 의사소통장애, 학습장애, 건강장애, 발달지연, 그 밖의 장애 등 다양한 장애를 기준으로 합니다. 고등학교 과정의 선정과정은 시·도 특별교육운영위원회의 심의를 거쳐야 하고, 중학교 이하 학교는 시·군·구 특별교육운영위원회가 결정합니다.
제16조 (교육지원의 선정절차 및 내용의 결정)
의뢰 시 30일 이내에 특수교육지원센터에서 진단 및 평가를 실시합니다. 센터는 그 결과를 바탕으로 특별교육 대상자 선정과 관련하여 최종 의견을 작성하고 필요한 교육 지원을 개략적으로 설명합니다. 그런 다음 이 의견을 교육청장이나 교육감에게 보고합니다. 이후 최종 의견서를 받은 후 2주 이내에 교육청이나 교육감이 교육지원 대상 선정과 세부 내용을 결정합니다. 이러한 결정은 특수교육, 진로 및 직업교육, 관련 서비스 등의 구체적인 측면을 포함하여 부모 또는 보호자에게 서면으로 전달됩니다. 진단 및 평가 과정 전반에 걸쳐 부모 또는 보호자가 의견을 표명할 수 있는 충분한 기회가 제공됩니다.
제17조(특수교육대상자의 배치 및 교육)
이 법은 특수 교육을 위해 선발된 개인의 배치 선택권을 개략적으로 설명합니다. 교육장 또는 교육감은 해당 특수교육운영위원회의 심사를 거쳐 일반학급, 일반학급 또는 특수학교 내 특수학급에 배치합니다. 거주지 근처에 배치하는 것을 선호하며, 개인의 장애 정도, 능력, 의견과 같은 요소들을 고려합니다. 교육감은 개인이 다른 시·도에 거주하는 경우에는 해당 교육감과 협의하여 적정한 배치를 결정합니다. 교육감 또는 국립학교의 장은 이러한 배치 요청을 받은 경우 대통령령으로 정하는 특별한 사유가 없는 한 일반적으로 이에 따릅니다. 배치 절차에 관한 더 자세한 사항은 대통령령으로 규정되어 있습니다.
장애인 등에 대한 특수교육법
제14조(장애의 조기발견 등) ① 교육장 또는 교육감은 영유아의 장애 및 장애 가능성을 조기에 발견하기 위하여 지역주민과 관련 기관을 대상으로 홍보를 실시하고, 해당 지역 내 보건소와 병원 또는 의원(醫院)에서 선별검사를 무상으로 실시하여야 한다.
② 교육장 또는 교육감은 제1항에 따른 선별검사를 효율적으로 실시하기 위하여 지방자치단체 및 보건소와 병ㆍ의원 간에 긴밀한 협조체제를 구축하여야 한다.
③ 보호자 또는 각급학교의 장은 제15조제1항 각 호에 따른 장애를 가지고 있거나 장애를 가지고 있다고 의심되는 영유아 및 학생을 발견한 때에는 교육장 또는 교육감에게 진단ㆍ평가를 의뢰하여야 한다. 다만, 각급학교의 장이 진단ㆍ평가를 의뢰하는 경우에는 보호자의 사전 동의를 받아야 한다.
④ 교육장 또는 교육감은 제3항에 따라 진단ㆍ평가를 의뢰받은 경우 즉시 특수교육지원센터에 회부하여 진단ㆍ평가를 실시하고, 그 진단ㆍ평가의 결과를 해당 영유아 및 학생의 보호자에게 통보하여야 한다.
⑤ 제1항의 선별검사의 절차와 내용, 그 밖에 검사에 필요한 사항과 제3항의 사전 동의 절차 및 제4항에 따른 통보 절차에 필요한 사항은 대통령령으로 정한다.
제15조(특수교육대상자의 선정) ① 교육장 또는 교육감은 다음 각 호의 어느 하나에 해당하는 사람 중 특수교육이 필요한 사람으로 진단ㆍ평가된 사람을 특수교육대상자로 선정한다. <개정 2016. 2. 3., 2021. 3. 23., 2021. 12. 28.>
1. 시각장애
2. 청각장애
3. 지적장애
4. 지체장애
5. 정서ㆍ행동장애
6. 자폐성장애(이와 관련된 장애를 포함한다)

11. 그 밖에 두 가지 이상의 장애가 있는 경우 등 대통령령으로 정하는 장애
② 교육장 또는 교육감이 제1항에 따라 특수교육대상자를 선정할 때에는 제16조제1항에 따른 진단ㆍ평가결과를 기초로 하여 고등학교 과정은 교육감이 시ㆍ도특수교육운영위원회의 심사를 거쳐, 중학교 과정 이하의 각급학교는 교육장이 시ㆍ군ㆍ구특수교육운영위원회의 심사를 거쳐 이를 결정한다.
제16조(특수교육대상자의 선정절차 및 교육지원 내용의 결정)
① 특수교육지원센터는 진단ㆍ평가가 회부된 후 30일 이내에 진단ㆍ평가를 시행하여야 한다.
② 특수교육지원센터는 제1항에 따른 진단ㆍ평가를 통하여 특수교육대상자로의 선정 여부 및 필요한 교육지원 내용에 대한 최종의견을 작성하여 교육장 또는 교육감에게 보고하여야 한다.
③ 교육장 또는 교육감은 특수교육지원센터로부터 최종의견을 통지받은 때부터 2주일 이내에 특수교육대상자로의 선정 여부 및 제공할 교육지원 내용을 결정하여 부모 등 보호자에게 서면으로 통지하여야 한다. 교육지원 내용에는 특수교육, 진로 및 직업교육, 특수교육 관련서비스 등 구체적인 내용이 포함되어야 한다.
④ 제1항에 따른 진단ㆍ평가의 과정에서는 부모 등 보호자의 의견진술의 기회가 충분히 보장되어야 한다.
제17조(특수교육대상자의 배치 및 교육)
① 교육장 또는 교육감은 제15조에 따라 특수교육대상자로 선정된 사람을 해당 특수교육운영위원회의 심사를 거쳐 다음 각 호의 어느 하나에 배치하여 교육하여야 한다. <개정 2021. 3. 23.>

② 교육장 또는 교육감은 제1항에 따라 특수교육대상자를 배치할 때에는 특수교육대상자의 장애정도ㆍ능력ㆍ보호자의 의견 등을 종합적으로 판단하여 거주지에서 가장 가까운 곳에 배치하여야 한다.
③ 교육감이 관할 구역 내에 거주하는 특수교육대상자를 다른 시ㆍ도에 소재하는 각급학교 등에 배치하고자 할 때에는 해당 시ㆍ도 교육감(국립학교의 경우에는 해당 학교의 장을 말한다)과 협의하여야 한다.
④ 제3항에 따라 특수교육대상자의 배치를 요구받은 교육감 또는 국립학교의 장은 대통령령으로 정하는 특별한 사유가 없으면 그 요구를 따라야 한다. <개정 2021. 3. 23.>
⑤ 제1항부터 제4항까지의 규정에 따른 특수교육대상자의 배치 등에 관하여 필요한 사항은 대통령령으로 정한다.
Articles 14, 15, 16, and 17 of the Special Education Act for Persons with Disabilities, etc. outline the process and standards for the selection and placement of individuals in need of special education. The following is a brief description of each clause.
Article 14 (Early detection of disabilities, etc.)
The law recognizes the importance of early detection and intervention of potential disabilities and disabilities in infants. For timely identification, the superintendent or superintendent of education is required to conduct free checkups at local health centers, hospitals, or clinics. It also supports efficient screening by establishing a cooperative system between local governments, health centers, hospitals, and clinics. If an infant or student's disability is suspected, the guardian or school authorities must ask the relevant education office or superintendent of education for diagnosis and evaluation with the consent of the guardian. Upon request, the Office of Education or the Superintendent of Education shall promptly request a case to the Special Education Support Center and deliver the diagnosis and evaluation results to infants and guardians. Specific screening procedures, consent and notification procedures are described in more detail by Presidential Decree.
Article 15 (Selection of Persons Subject to Special Education)
This law stipulates the criteria for selecting special education targets. The head of the school or the superintendent of education is responsible for selecting individuals diagnosed and evaluated as requiring special education. This selection is based on various disorders such as visual impairment, hearing impairment, intellectual disability, physical disability, emotional and behavioral disability, autism, communication disability, learning disability, health disability, developmental delay, and other disabilities prescribed by Presidential Decree. The selection process of high school courses must be reviewed by the city and provincial special education steering committees, and schools below middle school are decided by the city, county, and district special education steering committees.
Article 16 (Determination of selection procedures and contents of educational support)
The special education support center conducts diagnosis and evaluation within 30 days upon request. Based on the results, the Center will draw up a final opinion on the selection of special education candidates and outline the training support required. This opinion is then reported to the Commissioner of Education or the Superintendent of Education. Afterwards, within two weeks of receiving the final opinion, the Office of Education or the Superintendent of Education will decide on the selection and details of the education support target. These decisions are communicated in writing to parents or guardians, including specific aspects such as special education, career and vocational education, and related services. Throughout the diagnosis and evaluation process, parents or carers have ample opportunity to express their opinions.
Article 17 (Placement and education of persons eligible for special education)
The law outlines the placement options of individuals selected for special education. The head of the district office of education or the superintendent of education shall be assigned to a general class, a general class, or a special class in a special school after examination by the relevant Special Education Steering Committee. Preferably placed near your residence, taking into account factors such as individual disability, ability, and opinion. Where an individual resides in another Si/Do, the superintendent of the Office of Education shall determine the appropriate placement in consultation with the relevant superintendent of education. When the superintendent of education or the head of a national school receives such a request for placement, he or she generally follows it unless there is a special reason prescribed by Presidential Decree. Further details of the deployment procedure are prescribed by Presidential Decree.
Special Education Act for Persons with Disabilities, etc
Article 14 (Early Detection of Disabilities, etc.) (1) In order to detect the possibility of disability and disability of infants and toddlers early, the head of the education office or superintendent of education shall conduct screening tests free of charge at local public health centers, hospitals, or clinics.

④ 교육 When the head of the Office of Education or the superintendent of education is requested to diagnose and evaluate pursuant to paragraph (3), he/she shall immediately refer the diagnosis and evaluation to the special education support center and notify the infant and student's guardian of the results.
⑤ ⑤ The procedures and contents of the screening inspection under paragraph (1), other matters necessary for the inspection, and the procedures for prior consent under paragraph (3) and notification under paragraph (4) shall be prescribed by Presidential Decree.
Article 15 (Selection of Persons Subject to Special Education) (1) The head of the Office of Education or the superintendent of education shall select a person diagnosed and evaluated as a person in need of special education from among the following persons. <Revised February 3, 2016, March 23, 2021, December 28, 2021>

2. Deafness
3. Intellectual disability
4. Physical impairment
5. Emotional and behavioral disorders
6. Autistic disorders (including related disorders)
7. Communication impairment
8. Learning Disabilities

11. Disabilities prescribed by Presidential Decree, such as two or more other disabilities
② 교육 When the head of a school or the superintendent of education selects special education targets pursuant to paragraph (1), the superintendent of high school courses shall be reviewed by the Si/Do Special Education Steering Committee, and schools below the middle school course shall be reviewed by the Si/Gun/Gu Special Education Steering Committee.
Article 16 (Determination of selection procedures and details of education support for persons eligible for special education) (1) The Special Education Support Center shall conduct diagnosis and evaluation within 30 days after the diagnosis and evaluation are referred.
② 특수 The Special Education Support Center shall prepare a final opinion on whether to be selected as a special education target and the details of necessary education support through diagnosis and evaluation under paragraph (1) and report it to the head of the education office or the superintendent of education.
③ 교육 The head of the Office of Education or the superintendent of education shall determine whether to be selected as a special education target and the details of education support to be provided within two weeks from the receipt of the final opinion from the Special Education Support Center and notify the parents and other guardians in writing. The contents of educational support shall include specific details such as special education, career and vocational education, and services related to special education.
④ 제 In the process of diagnosis and evaluation under paragraph (1), the opportunity for parents and other guardians to state their opinions shall be sufficiently guaranteed.
Article 17 (Arrangement and Education of Persons Subject to Special Education) (1) The head of the Office of Education or the superintendent of education shall place a person selected for special education pursuant to Article 15 in any of the following subparagraphs after examination by the relevant Special Education Steering Committee. <Revised March 23, 2021>

② 교육 When the head of the Office of Education or the superintendent of education places special education targets pursuant to paragraph (1), he/she shall comprehensively determine the degree of disability, ability, opinions of guardians, etc. of special education targets and place them closest to his/her residence.
③ (3) When the superintendent of the Office of Education intends to assign special education targets residing in his/her jurisdiction to schools of various levels located in other Si/Do, he/she shall consult with the relevant superintendent of education (referring to the head of the relevant school in the case of a national school).
④ (4) The superintendent of the Office of Education or the head of a national school who has been requested to assign persons eligible for special education pursuant to paragraph (3) shall comply with such request, except in extenuating circumstances prescribed by Presidential Decree. <Revised March 23, 2021>
⑤ ⑤ Necessary matters concerning the placement, etc. of persons eligible for special education under paragraphs (1) through (4) shall be prescribed by Presidential Decree.
