성폭력처벌법 제7조는 13세 미만 미성년자를 대상으로 한 성폭력 범죄에 대한 처벌을 규정하고 있습니다. 만 13세 미만을 대상으로 강간죄를 범한 경우 무기징역 또는 10년 이상의 징역에 처합니다. 폭행이나 협박으로 생식기나 신체 부위를 입·항문·성대에 삽입하는 등 강제적인 성적 행위를 한 경우 7년 이상의 징역에 처합니다. 만약 그들이 13세 미만의 사람에게 강요된 괴롭힘을 저지른다면, 그들은 5년 이상의 징역에 처해질 것입니다.
또한 만 13세 미만의 사람을 대상으로 준강간 또는 준강제추행을 한 경우에는 제1항부터 제3항까지의 예에 따라 처벌합니다. 또한 위계 또는 권력에 의하여 13세 미만의 사람을 간음하거나 추행한 때에는 제1항부터 제3항까지의 예에 따라 처벌합니다.
이 규정들은 성폭력으로부터 미성년자들을 보호하고 그러한 범죄의 가해자들을 엄중한 처벌을 하기 위한 것입니다.
성폭력범죄의 처벌 등에 관한 특례법
제7조(13세 미만의 미성년자에 대한 강간, 강제추행 등)
① 13세 미만의 사람에 대하여 「형법」 제297조(강간)의 죄를 범한 사람은 무기징역 또는 10년 이상의 징역에 처한다.
② 13세 미만의 사람에 대하여 폭행이나 협박으로 다음 각 호의 어느 하나에 해당하는 행위를 한 사람은 7년 이상의 유기징역에 처한다.
1. 구강ㆍ항문 등 신체(성기는 제외한다)의 내부에 성기를 넣는 행위
2. 성기ㆍ항문에 손가락 등 신체(성기는 제외한다)의 일부나 도구를 넣는 행위
③ 13세 미만의 사람에 대하여 「형법」 제298조(강제추행)의 죄를 범한 사람은 5년 이상의 유기징역에 처한다. <개정 2020. 5. 19.>
④ 13세 미만의 사람에 대하여 「형법」 제299조(준강간, 준강제추행)의 죄를 범한 사람은 제1항부터 제3항까지의 예에 따라 처벌한다.
⑤ 위계 또는 위력으로써 13세 미만의 사람을 간음하거나 추행한 사람은 제1항부터 제3항까지의 예에 따라 처벌한다.
Article 7 of the Sexual Violence Punishment Act stipulates punishment for sexual violence crimes against minors under the age of 13. If you commit rape against a person under the age of 13, you will be sentenced to life in prison or imprisonment for more than 10 years. Forced sexual acts such as inserting genitals or body parts into the mouth, anus, or vocal cords through assault or intimidation, you will be sentenced to more than seven years in prison. In addition, if a person under the age of 13 is subjected to quasi-rape or quasi-forced harassment, he/she shall be punished in accordance with the examples of paragraphs (1) through (3). In addition, if a person under the age of 13 is sexually harassed or molested by hierarchy or power, he/she shall be punished in accordance with the examples of paragraphs 1 through (3).
These regulations are aimed at protecting minors from sexual violence and severely punishing perpetrators of such crimes.

Article 7 (Rape, forced harassment, etc. against minors under the age of 13) (1) A person who commits a crime under Article 297 (rape) of the Criminal Act against a person under the age of 13 shall be sentenced to life imprisonment or imprisonment for at least 10 years.
② A person who commits any of the following acts by assault or intimidation against a person under the age of 13 shall be punished by imprisonment with work for at least seven years.
1. The act of putting a genitalia inside the body (excluding the genitalia) such as the mouth and anus
2. The act of inserting parts or tools of the body (excluding the vocal cords) such as fingers into the vocal cords and the vocal cords
③ A person who commits a crime under Article 298 (forced harassment) of the Criminal Act against a person under the age of 13 shall be sentenced to imprisonment for not less than five years. <Revised May 19, 2020>
④ A person who commits a crime under Article 299 (semi-rape, quasi-forced harassment) of the Criminal Act against a person under the age of 13 shall be punished in accordance with the examples under paragraphs (1) through (3).
⑤ A person who commits adultery or molestation of a person under the age of 13 by virtue of hierarchy or power shall be punished in accordance with the examples under paragraphs (1) through (3).
