아동ㆍ청소년의 성보호(제13조,제14조. 아동청소년의 성을 사는 행위, 강요행위)에 관한 법률 Act on the Protection of Children and Adolescents' Sex (Act of Buying Children and Adolescents' Sex, Compulsory Act)

 

이 법들은 어린이와 청소년들로부터 성을 구매하는 행위와 관련이 있는데, 이것은 한국에서 불법입니다.

제13조는 아동·청소년으로부터 성매수를 한 사람은 징역 또는 벌금에 처한다고 규정하고 있습니다. 처벌은 징역 1년에서 10년, 벌금 2천만원에서 5천만원까지 다양합니다. 아동에게 성을 사줄 목적으로 성을 팔도록 유인하거나 부추기면 3년 이하의 징역 또는 3천만 원 이하의 벌금에 처합니다.

이 조항에 따라 16세 미만의 아동이나 청소년이 범죄를 저지르면 범죄에 규정된 형량의 2분의 1 이하로 더 엄하게 처벌됩니다.

제14조는 돈을 목적으로 아동과 청소년에게 성관계를 강요하거나 유도하는 사람들을 다루고 있습니다. 폭행이나 협박, 부채, 위계질서나 권력, 업무상 관계 등을 이용해 아이들이 성매수 행위에 가담하게 할 경우 최소 5년의 징역형을 받게 됩니다. 대가를 받거나 청탁이나 약속을 받으면 최소 7년 이상의 징역형을 받게 됩니다. 아동이나 청소년에게 성매수 행위를 유도하거나 부추기면 7년 이하의 징역 또는 5000만원 이하의 벌금에 처합니다. 미수범들도 처벌받을 것입니다.

이 법들은 아동과 청소년들을 성적 착취로부터 보호하고 그러한 불법 행위를 하는 사람들을 처벌하는 것을 목표로 합니다.

 

 

아동ㆍ청소년의 성보호에 관한 법률

제13조(아동ㆍ청소년의 성을 사는 행위 등) ① 아동ㆍ청소년의 성을 사는 행위를 한 자는 1년 이상 10년 이하의 징역 또는 2천만원 이상 5천만원 이하의 벌금에 처한다.

② 아동ㆍ청소년의 성을 사기 위하여 아동ㆍ청소년을 유인하거나 성을 팔도록 권유한 자는 3년 이하의 징역 또는 3천만원 이하의 벌금에 처한다. <개정 2021. 3. 23.>

③ 16세 미만의 아동ㆍ청소년 및 장애 아동ㆍ청소년을 대상으로 제1항 또는 제2항의 죄를 범한 경우에는 그 죄에 정한 형의 2분의 1까지 가중처벌한다. <신설 2020. 5. 19., 2020. 12. 8.>

 

 

These laws are related to the act of buying sex from children and adolescents, which is illegal in South Korea.

Article 13 states that a person who buys sex from children and adolescents will be punished with imprisonment or a fine. The punishment can range from one year to ten years in prison and a fine of 20-50 million won. If a person lures or encourages children to sell sex for the purpose of buying sex from them, they will face a punishment of up to three years in prison or a fine of up to 30 million won.

If a child or juvenile under the age of 16 commits a crime under these provisions, they will be punished more severely with up to 1/2 of the sentence prescribed for the crime.

Article 14 addresses those who force or induce children and adolescents to engage in sex for money. If a person uses assault or intimidation, debt, hierarchy or power, or work relationships to make children engage in the act of buying sex, they will face a punishment of at least five years in prison. If they receive consideration or request or promise it, they will face a punishment of at least seven years in prison. If a person induces or encourages a child or juvenile to engage in the act of buying sex, they will face a punishment of up to seven years in prison or a fine of up to 50 million won. Attempted offenders will also be punished.

These laws aim to protect children and adolescents from sexual exploitation and punish those who engage in such illegal activities.

 

 

Act on the Protection of Children and Juveniles (abbreviated as the Juvenile Sex Protection Act)
Article 13 (Act of buying the sex of children and adolescents, etc.) (1) A person who commits the act of buying the sex of children and adolescents shall be punished by imprisonment with work for not less than one year but not more than 10 years or a fine of not less than 20 million won and not more than 50 million won.

② A person who lures children and adolescents or encourages them to sell sex in order to buy the sex of children and adolescents shall be punished by imprisonment with work for not more than three years or a fine of not more than 30 million won. <Revised March 23, 2021>

③ Where a child or juvenile under the age of 16 commits a crime under paragraph (1) or (2), he/she shall be subject to aggravated punishment up to 1/2 of the sentence prescribed for the crime. <New May 19, 2020, December 8, 2020>
