또한 제8조의2는 장애인이 아닌 13세부터 16세까지의 아동 및 청소년에 대한 보호를 규정하고 있습니다. 아동의 빈곤 상태를 이용하거나 다른 사람과 간음을 강요하는 19세 이상의 사람은 최소 3년의 징역형을 받게 됩니다. 마찬가지로 만 19세 이상이 13~16세 아동이나 청소년을 추행하거나 다른 사람을 추행하게 할 경우 10년 이하의 징역 또는 5천만 원 이하의 벌금에 처해질 수 있습니다.

아동ㆍ청소년의 성보호에 관한 법률 ( 약칭: 청소년성보호법 )
제8조(장애인인 아동ㆍ청소년에 대한 간음 등) ① 19세 이상의 사람이 13세 이상의 장애 아동ㆍ청소년(「장애인복지법」 제2조제1항에 따른 장애인으로서 신체적인 또는 정신적인 장애로 사물을 변별하거나 의사를 결정할 능력이 미약한 아동ㆍ청소년을 말한다. 이하 같다)을 간음하거나 13세 이상의 장애 아동ㆍ청소년으로 하여금 다른 사람을 간음하게 하는 경우에는 3년 이상의 유기징역에 처한다. <개정 2020. 5. 19., 2020. 12. 8.>
② 19세 이상의 사람이 13세 이상의 장애 아동ㆍ청소년을 추행한 경우 또는 13세 이상의 장애 아동ㆍ청소년으로 하여금 다른 사람을 추행하게 하는 경우에는 10년 이하의 징역 또는 5천만원 이하의 벌금에 처한다. <개정 2020. 12. 8., 2021. 3. 23.>
제8조의2(13세 이상 16세 미만 아동ㆍ청소년에 대한 간음 등) ① 19세 이상의 사람이 13세 이상 16세 미만인 아동ㆍ청소년(제8조에 따른 장애 아동ㆍ청소년으로서 16세 미만인 자는 제외한다. 이하 이 조에서 같다)의 궁박(窮迫)한 상태를 이용하여 해당 아동ㆍ청소년을 간음하거나 해당 아동ㆍ청소년으로 하여금 다른 사람을 간음하게 하는 경우에는 3년 이상의 유기징역에 처한다.
② 19세 이상의 사람이 13세 이상 16세 미만인 아동ㆍ청소년의 궁박한 상태를 이용하여 해당 아동ㆍ청소년을 추행한 경우 또는 해당 아동ㆍ청소년으로 하여금 다른 사람을 추행하게 하는 경우에는 10년 이하의 징역 또는 5천만원 이하의 벌금에 처한다. <개정 2021. 3. 23.>

According to this law, any person aged 19 years or older who engages in sexual activity with a disabled child or adolescent aged 13 or older, who is unable to distinguish objects or make decisions due to physical or mental disabilities, will face a minimum sentence of three years in prison. Similarly, if a person aged 19 or older molests a disabled child or youth aged 13 or older or causes them to molest another person, they can be punished with imprisonment for up to 10 years or a fine of up to 50 million won.
In addition, Article 8-2 provides protection to children and adolescents aged 13 to 16 who are not disabled. Any person aged 19 or older who uses the child's poverty-stricken state or forces them to commit adultery with another person will face a minimum sentence of three years in prison. Similarly, if a person aged 19 or older molests a child or youth aged 13 to 16 or causes them to molest another person, they can be punished with imprisonment for up to 10 years or a fine of up to 50 million won.
