성폭력범죄의 처벌(제3조,제4조. 특수강도강간·특수강간)등에 관한 특례법 Act on Special Cases concerning the Punishment of Sexual Violence Crimes (Special Robbery and Special Rape)

 

 

한국에는 성폭력 범죄를 저지른 사람들을 처벌하는 특별법이 시행되고 있습니다. 제3조는 주거침입, 절도, 실종사건 등 강간, 강제추행, 준강간 등의 범죄에 대한 처벌을 규정하고 있습니다. 제330조 및 제331조에 따른 범죄를 저지르고 성폭력 범죄도 저지르면 무기징역 또는 7년 이상의 징역에 처해질 수 있습니다.

제4조는 강간과 강제추행을 구체적으로 다루고 있습니다. 흉기를 사용하거나 2명 이상의 도움을 받아 강간을 저지른 경우 무기 또는 7년 이상의 징역에 처할 수 있습니다. 누군가 이런 식으로 강제추행을 저지른다면 최소 5년의 징역형을 받을 수 있습니다. 준강간 및 준강제추행에 대해서는 흉기나 여러 명이 개입했는지 여부에 따라 처벌이 결정됩니다.

이 법들이 2020년 5월에 개정되었고, 최근 성폭력 범죄에 대한 처벌과 관련하여 헌법에 변화가 있었다는 점에 주목해야 합니다. 이 법들은 성폭력으로부터 개인을 보호하고 이러한 극악무도한 범죄를 저지른 사람들이 그들의 행동에 대한 책임을 지도록 하기 위해 존재합니다.

 

 

성폭력범죄의 처벌 등에 관한 특례법

제3조(특수강도강간 등) 

① 「형법」 제319조제1항(주거침입), 제330조(야간주거침입절도), 제331조(특수절도) 또는 제342조(미수범. 다만, 제330조 및 제331조의 미수범으로 한정한다)의 죄를 범한 사람이 같은 법 제297조(강간), 제297조의2(유사강간), 제298조(강제추행) 및 제299조(준강간, 준강제추행)의 죄를 범한 경우에는 무기징역 또는 7년 이상의 징역에 처한다. <개정 2020. 5. 19.>

② 「형법」 제334조(특수강도) 또는 제342조(미수범. 다만, 제334조의 미수범으로 한정한다)의 죄를 범한 사람이 같은 법 제297조(강간), 제297조의2(유사강간), 제298조(강제추행) 및 제299조(준강간, 준강제추행)의 죄를 범한 경우에는 사형, 무기징역 또는 10년 이상의 징역에 처한다.

[단순위헌, 2021헌가9, 2023.2.23, 성폭력범죄의 처벌 등에 관한 특례법(2020. 5. 19. 법률 제17264호로 개정된 것) 제3조 제1항 중 ‘형법 제319조 제1항(주거침입)의 죄를 범한 사람이 같은 법 제298조(강제추행), 제299조(준강제추행) 가운데 제298조의 예에 의하는 부분의 죄를 범한 경우에는 무기징역 또는 7년 이상의 징역에 처한다.’는 부분은 헌법에 위반된다.]

 

제4조(특수강간 등) 

① 흉기나 그 밖의 위험한 물건을 지닌 채 또는 2명 이상이 합동하여 「형법」 제297조(강간)의 죄를 범한 사람은 무기징역 또는 7년 이상의 징역에 처한다. <개정 2020. 5. 19.>

 

② 제1항의 방법으로 「형법」 제298조(강제추행)의 죄를 범한 사람은 5년 이상의 유기징역에 처한다. <개정 2020. 5. 19.>

 

③ 제1항의 방법으로 「형법」 제299조(준강간, 준강제추행)의 죄를 범한 사람은 제1항 또는 제2항의 예에 따라 처벌한다.

 

 

In Korea, a special law is in effect to punish those who commit sexual violence crimes. Article 3 stipulates punishment for crimes such as rape, forced harassment, and quasi-rape, such as home invasion, theft, and disappearance. If you commit a crime under Articles 330 and 331 and commit a sexual violence crime, you can be sentenced to life in prison or imprisonment for more than 7 years.

Article 4 specifically deals with rape and indecent assault. Use of a weapon or rape with the help of more than two people is punishable by life or imprisonment for more than seven years. If someone commits indecent assault in this way, they could face a minimum of five years in prison. Punishment for quasi-rape and quasi-forced harassment is determined by the weapon or whether several people have been involved.

It should be noted that these laws were amended in May 2020, and that there have recently been changes in the Constitution in relation to the punishment of sexual violence crimes. These laws exist to protect individuals from sexual violence and to hold those who commit these heinous crimes accountable for their actions.


Act on Special Cases concerning the Punishment, etc. of Sexual Violence Crimes (abbreviated as the Sexual Violence Punishment Act) [Enforcement July 1, 2022] [Act No. 18465, September 24, 2021]

Article 3 (Special Robbery rape, etc.) (1) Article 319 (1) of the Criminal Act (residential intrusion), Article 330 (nightly residential intrusion theft), Article 331 (special theft), or Article 342 (missing). However, if a person who commits the crime under Articles 330 and 331) commits the crimes under Articles 297 (rape), 297-2 (similar rape), 298 (forced harassment), and 299 (semi-rape, quasi-forced harassment), he/she shall be sentenced to life imprisonment or imprisonment for at least seven years. <Revised May 19, 2020>

② Article 334 (Special Strength) or Article 342 of the Criminal Act (Not attempted). However, if a person who commits an attempted crime under Article 334) commits the crimes under Articles 297 (rape), 297-2 (similar rape), 298 (forced harassment), and 299 (quasi-rape, quasi-rape), he/she shall be sentenced to death, life imprisonment, or imprisonment for more than 10 years.

[Simple unconstitutionality, 2021 Constitution 9, 2023.2.23, Special Act on the Punishment, etc. of Sexual Violence Crimes (amended by Act No. 17264, May 19, 2020)] "A person who commits a crime under Article 319 (1) of the Criminal Act shall be punished by imprisonment or imprisonment for more than 7 years."

Article 4 (Special rape, etc.) (1) A person who commits a crime under Article 297 (rape) of the Criminal Act with a weapon or other dangerous object or two or more persons jointly shall be sentenced to life in prison or imprisonment for at least seven years. <Revised May 19, 2020>

② A person who commits a crime under Article 298 (compulsory harassment) of the Criminal Act by the method referred to in paragraph (1) shall be sentenced to at least five years in prison. <Revised May 19, 2020>

③ A person who commits a crime under Article 299 (semi-rape, quasi-forced harassment) of the Criminal Act by the method referred to in paragraph (1) shall be punished in accordance with the example of paragraph (1) or (2).
