성희롱과 성폭행은 교통, 공연, 집회 장소 등 공공장소에서 발생할 수 있는 심각한 범죄입니다. 이러한 사건을 예방하고 해결하기 위해, 한국은 제11조와 제12조를 포함한 법을 시행하고 있습니다.

11조는 공공장소에서 누군가를 추행한 사람은 3년 이하의 징역 또는 3천만 원 이하의 벌금에 처해질 수 있다고 규정하고 있습니다. 이것은 버스나 콘서트와 같은 공공 장소에서 누군가에게 원치 않는 신체적 접촉이나 성적인 접근을 포함합니다.

제12조는 성적 목적으로 다중이용장소를 침범하는 행위를 다루고 있습니다. 이 법은 여러 명이 같은 시설을 사용하는 욕실, 욕실, 사우나, 탈의실 또는 기타 장소에 침입하여 성적인 행위를 하는 것을 금지하고 있습니다. 위반자는 1년 이하의 징역 또는 1천만 원 이하의 벌금에 처해질 수 있습니다.

성폭력범죄의 처벌 등에 관한 특례법

제11조(공중 밀집 장소에서의 추행) 대중교통수단, 공연ㆍ집회 장소, 그 밖에 공중(公衆)이 밀집하는 장소에서 사람을 추행한 사람은 3년 이하의 징역 또는 3천만원 이하의 벌금에 처한다. <개정 2020. 5. 19.>

 제12조(성적 목적을 위한 다중이용장소 침입행위) 자기의 성적 욕망을 만족시킬 목적으로 화장실, 목욕장ㆍ목욕실 또는 발한실(發汗室), 모유수유시설, 탈의실 등 불특정 다수가 이용하는 다중이용장소에 침입하거나 같은 장소에서 퇴거의 요구를 받고 응하지 아니하는 사람은 1년 이하의 징역 또는 1천만원 이하의 벌금에 처한다. <개정 2017. 12. 12., 2020. 5. 19.>

 

 

Sexual harassment and sexual assault are serious crimes that can occur in public places such as traffic, performances, and assembly places. To prevent and resolve such incidents, South Korea is enforcing laws, including Articles 11 and 12.

Article 11 stipulates that anyone who molests someone in public can face up to three years in prison or a fine of up to 30 million won. This includes unwanted physical contact or sexual access to someone in public places, such as buses and concerts.

Article 12 deals with the act of invading a multi-use place for sexual purposes. The law prohibits multiple people from breaking into bathrooms, bathrooms, saunas, changing rooms or other places where they use the same facility. Violators can be sentenced to up to one year in prison or fined up to 10 million won.

These laws are designed to protect individuals from sexual harassment and sexual assault in public and to make perpetrators face serious consequences for their actions. It is important to remember that such behavior is never acceptable and that victims have the right to speak out and report on sexual harassment or assault cases.

Article 11 (Misconduct in a Public Place) A person who molests a person in a public transportation, performance or assembly place, or other public places shall be punished by imprisonment for not more than three years or a fine of not more than 30 million won. <Revised May 19, 2020>

Article 12 (Act of Invasion of Multi-use Places for Sexual Purpose) A person who breaks into a multi-use place used by an unspecified number of people, such as a bathroom, bath, bath, or sweating room, or changing room, shall be sentenced to up to one year in prison or fined up to KRW 10 million. <Revised December 12, 2017, May 19, 2020>
