성폭력범죄의 처벌(제24조. 피해자의 신원과 사생활 비밀 누설금지)등에 관한 특례법 Act on Special Cases concerning the Punishment of Sexual Violence Crimes (Prohibition of Leakage of Victims' Identity and Privacy Secrets)

 

성폭력범죄의 처벌등에 관한 특례법에서 피해자 보호를 위해 아래와 같이 규정하고 있습니다.

대한민국 성범죄의 처벌 및 피해자 보호에 관한 법률 제24조는 성폭력 범죄의 수사 또는 재판에 관여하는 자에 의한 피해자의 개인정보 및 사생활 비밀의 공개를 금지하고 있습니다. 여기에는 피해자의 이름, 주소, 직업, 학교, 외모와 같은 세부 사항뿐만 아니라 그들을 식별할 수 있는 모든 사진이 포함됩니다.

예를 들어 여성이 경찰에 성폭행을 신고하면 수사에 참여한 경찰관들이 본인 동의 없이 자신의 신상이나 사진을 타인에게 공개하는 것이 금지됩니다. 마찬가지로, 신문이나 TV 방송국이 그 사건에 대해 보도한다면, 그들은 피해자의 동의 없이는 피해자의 이름이나 신원을 확인하는 정보를 발표할 수 없습니다. 이것은 피해자의 사생활을 보호하고 그들이 더 이상 피해를 입거나 오명을 쓰는 것을 막기 위한 것입니다.

 

 

성폭력범죄의 처벌 등에 관한 특례법 

제24조(피해자의 신원과 사생활 비밀 누설 금지) 

① 성폭력범죄의 수사 또는 재판을 담당하거나 이에 관여하는 공무원 또는 그 직에 있었던 사람은 피해자의 주소, 성명, 나이, 직업, 학교, 용모, 그 밖에 피해자를 특정하여 파악할 수 있게 하는 인적사항과 사진 등 또는 그 피해자의 사생활에 관한 비밀을 공개하거나 다른 사람에게 누설하여서는 아니 된다.

 

② 누구든지 제1항에 따른 피해자의 주소, 성명, 나이, 직업, 학교, 용모, 그 밖에 피해자를 특정하여 파악할 수 있는 인적사항이나 사진 등을 피해자의 동의를 받지 아니하고 신문 등 인쇄물에 싣거나 「방송법」 제2조제1호에 따른 방송 또는 정보통신망을 통하여 공개하여서는 아니 된다.

 

 

 

The Special Act on the Punishment of Sexual Violence Crimes stipulates as follows to protect victims.

Article 24 of the Act on the Punishment and Protection of Victims of Sexual Crimes in Korea prohibits the disclosure of personal information and privacy secrets of victims by those involved in the investigation or trial of sexual violence crimes. This includes details such as the victim's name, address, occupation, school, and appearance, as well as any pictures that can identify them.

For example, if a woman reports sexual assault to the police, police officers who participated in the investigation are prohibited from disclosing their identities or photos to others without their consent. Likewise, if a newspaper or TV station reports on the incident, they cannot publish information identifying the victim's name or identity without the consent of the victim. This is to protect the victim's privacy and prevent them from being further damaged or stigmatized.

Article 24 (Prohibition of divulging Victim's identity and privacy secrets) (1) No public official or person in charge of or involved in the investigation or trial of sexual violence crimes shall disclose or disclose secrets related to the Victim's privacy to others, such as his address, name, occupation, school, appearance, or other personal information and photos.

② No person shall publish the victim's address, name, age, occupation, school, appearance, or other personal information or photos that can identify the victim under paragraph (1) in a newspaper, etc. without the victim's consent, or disclose them through broadcasting or information and communication networks under subparagraph 1 of Article 2 of the Broadcasting Act.
