한국 정부는 성범죄, 가짜 영상 유포, 사진을 이용한 협박과 강요와 관련된 여러 기사를 수정하고 추가했습니다.
제13조는 성욕을 유도하거나 충족시키기 위해 통신매체를 통해 접촉한 사람은 징역 또는 벌금에 처해질 수 있다고 규정하고 있습니다.
제14조는 카메라나 이와 유사한 기능을 이용하여 성욕이나 수치심을 유발하기 위하여 누군가의 신체를 촬영하거나 촬영한 자는 징역 또는 벌금에 처해질 수 있다고 규정하고 있습니다. 이러한 사진이나 동영상을 배포, 판매, 임대, 제공 또는 공개적으로 전시하거나 상영하는 사람도 처벌받을 수 있습니다.
제14조의2는 사람의 얼굴, 신체 또는 목소리를 대상으로 한 사진, 영상 또는 음성을 편집, 합성 또는 가공한 자는 처벌할 수 있다고 규정하고 있는 가짜 영상의 유통을 다루고 있습니다. 이런 가짜 동영상을 유포하는 것도 처벌을 받을 수 있습니다.
제14조의3은 성욕이나 수치심을 유발할 수 있는 사진이나 복제물을 이용한 협박과 강요에 관한 것입니다. 이러한 자료를 이용하여 사람을 협박한 자는 징역형에 처해질 수 있고, 협박하여 사람의 권리를 침해하거나 의무가 아닌 일을 하게 한 자는 더 높은 형량을 받을 수 있습니다.
이러한 범죄의 상습범은 규정된 형량의 최대 절반의 가중형을 받을 수 있습니다. 이 조항들은 2020년 5월 19일에 개정 및 추가되었고, 2020년 3월 24일에 제14조의3이 추가되었습니다.
성폭력범죄의 처벌 등에 관한 특례법
제13조(통신매체를 이용한 음란행위) 자기 또는 다른 사람의 성적 욕망을 유발하거나 만족시킬 목적으로 전화, 우편, 컴퓨터, 그 밖의 통신매체를 통하여 성적 수치심이나 혐오감을 일으키는 말, 음향, 글, 그림, 영상 또는 물건을 상대방에게 도달하게 한 사람은 2년 이하의 징역 또는 2천만원 이하의 벌금에 처한다. <개정 2020. 5. 19.>
제14조(카메라 등을 이용한 촬영) ① 카메라나 그 밖에 이와 유사한 기능을 갖춘 기계장치를 이용하여 성적 욕망 또는 수치심을 유발할 수 있는 사람의 신체를 촬영대상자의 의사에 반하여 촬영한 자는 7년 이하의 징역 또는 5천만원 이하의 벌금에 처한다. <개정 2018. 12. 18., 2020. 5. 19.>
② 제1항에 따른 촬영물 또는 복제물(복제물의 복제물을 포함한다. 이하 이 조에서 같다)을 반포ㆍ판매ㆍ임대ㆍ제공 또는 공공연하게 전시ㆍ상영(이하 “반포등”이라 한다)한 자 또는 제1항의 촬영이 촬영 당시에는 촬영대상자의 의사에 반하지 아니한 경우(자신의 신체를 직접 촬영한 경우를 포함한다)에도 사후에 그 촬영물 또는 복제물을 촬영대상자의 의사에 반하여 반포등을 한 자는 7년 이하의 징역 또는 5천만원 이하의 벌금에 처한다. <개정 2018. 12. 18., 2020. 5. 19.>
③ 영리를 목적으로 촬영대상자의 의사에 반하여 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 제2조제1항제1호의 정보통신망(이하 “정보통신망”이라 한다)을 이용하여 제2항의 죄를 범한 자는 3년 이상의 유기징역에 처한다. <개정 2018. 12. 18., 2020. 5. 19.>
④ 제1항 또는 제2항의 촬영물 또는 복제물을 소지ㆍ구입ㆍ저장 또는 시청한 자는 3년 이하의 징역 또는 3천만원 이하의 벌금에 처한다. <신설 2020. 5. 19.>
⑤ 상습으로 제1항부터 제3항까지의 죄를 범한 때에는 그 죄에 정한 형의 2분의 1까지 가중한다. <신설 2020. 5. 19.>
제14조의2(허위영상물 등의 반포등) ① 반포등을 할 목적으로 사람의 얼굴ㆍ신체 또는 음성을 대상으로 한 촬영물ㆍ영상물 또는 음성물(이하 이 조에서 “영상물등”이라 한다)을 영상물등의 대상자의 의사에 반하여 성적 욕망 또는 수치심을 유발할 수 있는 형태로 편집ㆍ합성 또는 가공(이하 이 조에서 “편집등”이라 한다)한 자는 5년 이하의 징역 또는 5천만원 이하의 벌금에 처한다.
② 제1항에 따른 편집물ㆍ합성물ㆍ가공물(이하 이 항에서 “편집물등”이라 한다) 또는 복제물(복제물의 복제물을 포함한다. 이하 이 항에서 같다)을 반포등을 한 자 또는 제1항의 편집등을 할 당시에는 영상물등의 대상자의 의사에 반하지 아니한 경우에도 사후에 그 편집물등 또는 복제물을 영상물등의 대상자의 의사에 반하여 반포등을 한 자는 5년 이하의 징역 또는 5천만원 이하의 벌금에 처한다.
③ 영리를 목적으로 영상물등의 대상자의 의사에 반하여 정보통신망을 이용하여 제2항의 죄를 범한 자는 7년 이하의 징역에 처한다.
④ 상습으로 제1항부터 제3항까지의 죄를 범한 때에는 그 죄에 정한 형의 2분의 1까지 가중한다. <신설 2020. 5. 19.>

제14조의3(촬영물 등을 이용한 협박ㆍ강요) ① 성적 욕망 또는 수치심을 유발할 수 있는 촬영물 또는 복제물(복제물의 복제물을 포함한다)을 이용하여 사람을 협박한 자는 1년 이상의 유기징역에 처한다.
② 제1항에 따른 협박으로 사람의 권리행사를 방해하거나 의무 없는 일을 하게 한 자는 3년 이상의 유기징역에 처한다.
③ 상습으로 제1항 및 제2항의 죄를 범한 경우에는 그 죄에 정한 형의 2분의 1까지 가중한다.

Article 13 stipulates that a person who has contacted through a communication medium to induce or satisfy sexual desire may be sentenced to imprisonment or fined.
Article 14 stipulates that a person who photographs or photographs someone's body using a camera or similar function to cause sexual desire or shame may be sentenced to imprisonment or a fine. Anyone who distributes, sells, leases, offers, or publicly displays or screens these photos or videos may also be punished.
Article 14-2 deals with the distribution of fake images that stipulate that anyone who edits, synthesizes, or processes photographs, images or voices targeting a person's face, body, or voice can be punished. Distributing these fake videos could also be punished.
Article 14-3 is about intimidation and coercion using photographs or reproductions that can cause sexual desire or shame. Those who use these data to intimidate a person can be sentenced to prison, and those who threaten to violate a person's rights or do something that is not mandatory can receive a higher sentence.
Recurring offenders of these crimes are subject to a heavier sentence of up to half the prescribed sentence. These provisions were amended and added on May 19, 2020, and Article 14-3 was added on March 24, 2020.

Article 13 (Lawful Acts Using Communication Media) A person who reaches the other party through telephone, mail, computer, or other communication media to induce or satisfy his or her sexual desire shall be punished by imprisonment for not more than two years or a fine of not more than 20 million won. <Revised May 19, 2020>
Article 14 (Shooting using a camera, etc.) (1) A person who photographs the body of a person who may cause sexual desire or shame using a camera or other similar function shall be punished by imprisonment for not more than seven years or a fine of not more than 50 million won. <Revised December 18, 2018, May 19, 2020>
② Photographs or reproductions under paragraph (1) (including reproductions of reproductions). A person who distributes, sells, leases, provides, or publicly displays or screens (hereinafter referred to as "repeat, etc.") or shoots under paragraph (1) are not contrary to the photographer's intention at the time of filming (including the case of directly photographing his/her body). <Revised December 18, 2018, May 19, 2020>
③ A person who commits a crime under paragraph (2) using an information and communication network (hereinafter referred to as "information and communication network") under Article 2 (1) 1 of the Information and Communication Network Utilization Promotion, Information Protection, etc. Act shall be sentenced to at least three years of imprisonment. <Revised December 18, 2018, May 19, 2020>
④ A person who possesses, purchases, stores, or watches photographs or reproductions under paragraph (1) or (2) shall be punished by imprisonment with work for not more than three years or a fine of not more than 30 million won. <New May 19, 2020>
⑤ Where a crime under paragraphs (1) through (3) is committed habitually, up to 1/2 of the sentence prescribed for the crime shall be aggravated. <New May 19, 2020>
Article 14-2 (Distribution of Fake Videos, etc.) (1) A person who edits, synthesizes, or processes a photograph, video, or voice (hereinafter referred to as "video, etc.") targeting a person's face, body, or voice (hereinafter referred to as "edit, etc." in this Article) shall be punished by imprisonment for not more than 5 million years.
② Edited materials, composites, and processed products under paragraph (1) (hereinafter referred to as "edited materials, etc." in this paragraph) or reproductions (including reproductions of reproductions). (hereinafter the same shall apply in this paragraph) Even if it is not contrary to the intention of the person subject to video, etc., a person who distributes video, etc. afterwards shall be punished by imprisonment for not more than five years or a fine of not more than 50 million won.
③ A person who commits a crime under paragraph (2) using an information and communication network against the will of a person subject to video, etc. for the purpose of profit shall be punished by imprisonment with work for not more than seven years.
④ Where a crime under paragraphs (1) through (3) is committed habitually, up to 1/2 of the sentence prescribed for the crime shall be aggravated. <New May 19, 2020>

Article 14-3 (Threatening and forcing using photographs, etc.) (1) A person who threatens a person using photographs or reproductions (including reproductions of reproductions) that may cause sexual desire or shame shall be sentenced to imprisonment for at least one year.
② A person who interferes with the exercise of a person's rights or causes him/her to do something that is not mandatory by threatening under paragraph (1) shall be punished by imprisonment with labor for at least three years.
③ Where a crime under paragraphs (1) and (2) is committed habitually, up to 1/2 of the sentence prescribed for the crime shall be aggravated.
