성폭력범죄의 처벌(제5조. 친족관계에 의한 강간)등에 관한 특례법 Act on Special Cases concerning the Punishment of Sexual Violence Crimes (Rape by Relation)

 

성폭력처벌법 제5조는 피해자와 친족관계에 있는 사람이 저지른 강간 및 강제추행 사건과 관련이 있습니다. 친족관계에 있는 사람이 폭행이나 협박으로 다른 사람에게 강간을 저질렀을 경우 최소 7년의 징역형을 받을 수 있습니다. 친족관계에 있는 사람이 폭행이나 협박 등을 통해 다른 사람을 강제 추행할 경우 최소 5년 이상의 징역형을 받을 수 있습니다. 친족관계에 있는 사람이 그 사람을 상대로 제299조(준강간, 준강제추행)에 따른 죄를 범한 경우에는 제1항 또는 제2항의 예에 따른 처벌을 받을 수 있습니다. "친척관계"의 정의는 4촌 이내의 친척 또는 친척과 함께 사는 사람들과 사실관계에 기초한 사람들을 포함합니다.

 

 

성폭력범죄의 처벌 등에 관한 특례법 

제5조(친족관계에 의한 강간 등) ① 친족관계인 사람이 폭행 또는 협박으로 사람을 강간한 경우에는 7년 이상의 유기징역에 처한다.

② 친족관계인 사람이 폭행 또는 협박으로 사람을 강제추행한 경우에는 5년 이상의 유기징역에 처한다.

③ 친족관계인 사람이 사람에 대하여 「형법」 제299조(준강간, 준강제추행)의 죄를 범한 경우에는 제1항 또는 제2항의 예에 따라 처벌한다.

④ 제1항부터 제3항까지의 친족의 범위는 4촌 이내의 혈족ㆍ인척과 동거하는 친족으로 한다.

⑤ 제1항부터 제3항까지의 친족은 사실상의 관계에 의한 친족을 포함한다.

 

 

 

Article 5 of the Sexual Violence Punishment Act is related to rape and forced harassment committed by a person who is related to the victim. A person in a kinship can face a minimum of seven years in prison if he or she commits rape to another person by assault or intimidation. If a person in a kinship forcibly molests another person through assault or intimidation, he or she can be sentenced to at least five years in prison. Where a person in a kinship commits a crime under Article 299 (semi-rape, quasi-forced harassment) against the person, he/she may be punished under the example of paragraph (1) or (2). The definition of "relationship" includes people living with relatives or relatives within the fourth degree and those based on facts.

Article 5 (Rape by Relative Relationship, etc.) (1) Where a person with a relative rape a person by assault or intimidation, he/she shall be sentenced to imprisonment for not less than seven years.

② Where a person in a kinship forcibly molests a person by assault or intimidation, he/she shall be sentenced to at least five years in prison.

③ Where a person who is related to a relative commits a crime under Article 299 (semi-rape, quasi-forced harassment) of the Criminal Act against a person, he/she shall be punished in accordance with the example of paragraph (1) or (2).

④ The scope of relatives under paragraphs (1) through (3) shall be relatives living with relatives or relatives within the fourth degree.

⑤ Relatives under paragraphs (1) through (3) include relatives based on de facto relationships.
