2. 13세 미만(또는 16세 미만) 아동 관련 성범죄:

 • 가해자가 만 19세 이상이면 형법 제305조, 아동청소년보호법 제20조 제3항에 따라 처벌합니다.

 아동·청소년 중에서도 13세 미만(가해자가 19세 이상이면 13세 이상 16세 미만)의 사람에 대한 간음 또는 추행은 강간이나 강제추행 등으로 처벌이 되고, 공소시효도 적용되지 않는 등 일반 성범죄에 대한 처벌보다 엄중하게 처벌하고 있습니다(「형법」 제305조 및 「아동·청소년의 성보호에 관한 법률」 제20조제3항).

 

※ 강간(强姦) : 폭행 또는 협박으로 사람을 강제로 간음하는 것을 말합니다.

 

※ 유사강간(類似强姦) : 폭행 또는 협박으로 사람에 대하여 구강, 항문 등 신체(성기는 제외함)의 내부에 성기를 넣거나 성기, 항문에 손가락 등 신체(성기는 제외함)의 일부 또는 도구를 넣는 행위를 말합니다.

 

※ 추행(醜行) : 성욕의 흥분 또는 만족을 얻을 동기로 행해진 정상의 성적인 수치감정을 심히 해치는 성질을 가진 행위를 말합니다. 이 행위는 남녀·연령 여하를 불문하고 그 행위가 범인의 성욕을 자극·흥분시키거나 만족시킨다는 성적 의도 하에 행해짐을 필요로 합니다.
